2026 Hay Permits
The Municipal District of Pincher Creek No. 9 issues permits to cut hay on municipal road rights-of-way within the MD.
Requirements:

Permits will be issued to adjoining property owners only upon receipt of a written application received by May 15 of each year.

Written applications received from ratepayers who are not adjoining property owners will be accepted after May 16 of each year with permits being issued by the end of May. In the event two or more written applications are received for the same municipal road rights-of-way, prior to the end of May, the rights-of-way requested will be allocated (divided) as equally as possible between the applicants.

Applications received following the deadline may not be approved.

All applications for a permit shall be completed by the applicant prior to a permit being issued. If all the information is not provided, the permit will not be processed.

The applicant must ensure the correct legal description of the municipal road rights-of-way applied for are correct.

The Permit to Cut Hay on Municipal road Rights-of-Way is as per attached Application.

In consideration of granting this permit, the permit holder:

Indemnifies and saves harmless the Municipal District of Pincher Creek No.9 from any claims arising from this permit.

Permit holder must carry out haying operations in such a manner that no hazard to traffic will exist (ex: equipment shall move in the same direction as traffic for the first pass)

Will leave the bales at least 3 metres from the edge of the road surface with the bales to be removed within 2 weeks after baling of each year and there will be no storage of bales in the right-of -way.

Will not sublet or sell the rights granted under this permit.

Will satisfy themselves as to the presence of herbicides or pesticides.

Will operate equipment off the running surface of municipal roads.

Will replace damaged signs and culverts, damaged by the Permit holder, at their expense.

Not perform haying operations during local fire bans.

Without limiting its own obligations herein and at its own expense, provide and maintain, in accordance with the Insurance Act, RSA 2000, c. I-3, as amended and replaced from time to time, automobile liability insurance in an amount not less than $2,000,000. Proof of insurance satisfactory to the Municipality in the form of a certificate of insurance must be attached to this Permit to be valid.

The Municipal District of Pincher Creek No. 9 has the right to revoke a permit to a former permit holder if past performance was non-complying with the above guidelines.

A copy of the approved Permits will be provided to Public Works and the Agricultural Environmental Services.

That the Municipal District reserves the right to deal with Prohibited Noxious and Noxious Weeds within the road right of way and will inform the permitted hay cutter as to the extent of any spraying that has occurred when asked.
