The below notice contains important information for residents and businesses along the East and Southeast side of the highway in Beaver Mines relating to clearing and grubbing.
As part of BYZ’s contract, fencing will be installed along the East and Southeast border of the Hamlet on property line for properties highlighted in yellow in the attached sketch. This will require additional clearing/grubbing adjacent to various properties.
Please note that along the Southeast side of the Hamlet the fence will be installed along Southeast border of the MD laneways. If there are any concerns regarding off-property encroachments and clearing please respond and let us know prior to May 29th.

CONSTRUCTION UPDATE

Please refer to the attached map for projected sequencing and upcoming activities for the continuation of Construction on the Beaver Mines Water and Wastewater Collection and Distribution System.
BYZ intends to start full mobilization again next week, and (weather pending) start underground work again May 1st, 2023.
The MD of Pincher Creek continues to plan for and remains optimistic that the bulk of construction work for Beaver Mines related projects will finish this year. A “turning on the taps” date is still anticipated to occur in Fall 2023. We plan to release more details regarding the processes and permitting requirements (Utility Services Guidelines) for connection to the system, along with the related pre-qualified contractor process, within the coming month.

The MD Council heard comments and concerns and made changes to the proposed bylaw prior to 2nd reading. 3nd reading of the bylaw is scheduled for Council deliberation at the regular meeting of council February 28th, 6PM at the MD Council Chambers (1037 Herron Avenue). 3rd reading is required before a bylaw can go into effect.
The following critical changes from the path laid out in the November 2nd, 2022 letter to property owners are as follows:
1) Requirements regarding alternate water source decommissioning (i.e. wells) removed from bylaw. Connection to the water and wastewater system will remain mandatory and alternate water systems cannot be connected/have the ability to “cross-flow” with the municipal system
2) The proposed utility bylaw waives the cost of supplying the meter for owners whom connect to the system within 9 months of the MD’s allowed connection date (previously 30 days)

A public hearing was held January 10th, 2023 regarding Utility Bylaw 1344-22 which will affect water and wastewater servicing within the Hamlet of Beaver Mines. We thank all the property owners whom took the time to attend the hearing and/or send in comments regarding the bylaw.

BYZ will be oiling the road on 2nd Ave , 4th St and 5th St starting today (Tuesday) afternoon. It is imperative we stay off the road during this process as it can cause damage to the vehicles.

The paving company will start production on 2nd Ave starting Tuesday morning (October 4th) that will require no access on 2nd Ave until Friday. The pavement will be hot and with the magnitude of equipment in place, this is the safest approach for residents. If BYZ is able to open up sooner we will advise. Parking off of 5th St is still available.

Second Ave Notice
June 17, 2022
Due to weather issues, interruption in construction has taken place. BYZ will continue to monitor weather conditions over the weekend.
Access to the South cul-de-sac of 2nd avenue is expected to remain closed. When weather permits, the work originally scheduled to start on June 14th at the 2nd avenue and 5th street intersection will begin, which could be as early as this weekend.
Residents will be notified of any significant changes to this schedule and appreciate your continued patience.

Construction work originally scheduled to start on June 14th on 2nd Avenue is now expected to begin June 16th along the originally indicated corridor. Work is still expected to last 17 days, pending any more weather disruption.

Construction Crews will be doing work on the bulk water station on Grumpy Road (Range Road 22-A). Crews will be on site starting tomorrow (October 14, 2021) and expect to be in the area until the end of next week.
During that time the road will be open but delays could happen when trucks are coming in and out with the fill material. Disturbance should be minimal.

This notice is to keep you up to date on the construction project. Currently we are completing drilling behind the tennis courts/parks area and drilling adjacent to the highway. We will begin working within the red area by our laydown on 16 September which should be completed in approximately 3 weeks. BYZ will be working on 11 & 12 September 2021. Personnel will be on site to address any questions that may arise.

Not much new to update other than our tender for the distribution and collection has been extended to July 20th when the tenders will be opened in Lethbridge. A short review period of the tenders will result in a successful bidder being chosen – normally a few days after the tenders are opened. So we should have a contractor selected by the last week of July or early August. Once this company and their availability to commence the project is determined, we will be holding an open house prior to them beginning. Please keep an eye on this website for confirmation of the date of the open house and further updates over the summer.

Major Project Update
The MD of Pincher Creek No 9 has received Ministerial and Final Approval for our Beaver Mines Water and Waste Water Projects.
We are pleased to announce that this project will move forward and want to take this opportunity to thank all of those that have worked with us to make this project a reality, especially the Beaver Mines Community Advisory Group who have reviewed and suggested changes all along the way, that have now been incorporated into the plans with our engineers. We also would like to thank the residents for their continued patience as we go through the next couple of “build season” years as your hamlet goes through some major growing pains. Together, we can make this happen as painless as possible. To those that have issued Statements of Concerns, we thank you as well, for now we have an even more robust system that we can all have confidence in as we move to the next stage of the process. This Approval clearly states that the AEP has reviewed and listened to our plans, the Statements of Concern and are confident in the system we have proposed in its planned location. We truly look forward to bring this entire project to completion 2023.

The MD filed its updated Draft Approval and signed Letter of Understanding with the Department of Environment and Parks on Friday, June 25, 2021. The Department will now review the amended Draft with their Peer Committee and issue further changes or grant Final Approval. We are expecting to hear from the Department within the next two weeks.
Tenders have been released for the Distribution and Collection system work, which are not part of the Waste System that is awaiting approval. This way, work can begin in the Hamlet this summer or allow the contractors to purchase supplies and prep for Q2, 2022. Obviously, the more we get done this year, the better.
Grant extensions have been sought, and one has been confirmed already. We are just waiting for the other grant to be authorized to extend the project into the 2023 build year. The delays experienced to date have pushed the limits of what is realistically achievable in the time allotted, so extensions had to be sought.
A modified timeline will be released shortly with key benchmark dates for your information.
A bulk water station is currently being considered, and land is being sought with a landowner outside the Hamlet. Negotiations are ongoing, and the pre-engineered drawings/build estimates are being completed this week for presentation to Council on July 13.

Draft approval has been granted by Alberta Environment and Parks for the Beaver Mines Water and Waste Water Project. MD Admin as well as our two engineering firms are currently reviewing the Draft Approval terms and conditions with legal counsel. Until final approval is granted, we appreciate your continued patience as we have all taken another big step forward in making this project a reality for this Hamlet within our MD. This draft approval truly speaks to the efforts we have all taken to ensure we are pursuing a technically and environmentally conscious system for generations to come.

Beaver Mines System Approval
May Update
We are currently awaiting AEP draft approval, which is expected imminently. Both Engineering companies are now tender ready.
Once draft approval is obtained, a quick window for comment or questions is held between the Department of Environment and Parks and our engineering firms to address any questions or concerns. Normally this takes a week or two to complete, then Final Approval can be granted.
If there are no conditions on our Draft Approval we will be proceeding to tender. If, however, there are conditions, we will wait for Final Approval before going to tender with our projects. While the tender is out, we will complete our pre-build discussions with the BM CAG, Beaver Mines Community Advisory Group, and possibly hold another virtual open house to inform everyone of the next steps and how the project is slated to proceed.
With the tenders being out for 3 -4 weeks, construction is slated in early July. Construction will continue until September/October/ November, weather permitting. Different parts of the project can be completed under different conditions. We will do all we can in 2021 so that we tentatively finish all subsurface work by Aug/Sept 2022. We are predicting that the resurfacing of the roads may carry-over to 2023.
We are also exploring a staged completion for anything that is done in 2021, with the possibility that those that can be hooked up can be fully operational. Normally a system needs to be completely installed prior to it being pressurized and operational. We are looking at the option of seeing where we are in September to try to cap and pressurize the system at that point and make it operational for as many residents as we can for the winter of 2021/22 and then we will carry on with our work in Spring 2022 to complete the installations and hookups. This is best case scenario only and should not be counted on by homeowners at this time, but we thought it prudent to explore the possibility.
Thank you for your continued patience as we strive to successfully complete the Beaver Mines Water and Wastewater projects. We understand there is a small minority of residents opposed to these projects. We can assure you, based on science and facts we are proceeding with the most environmentally conscious and technically sound system we could find. We remain focused on delivering these services to the hamlet of Beaver Mines and look forward to the opportunity to mitigate any concerns residents/landowners may have. We are here to serve and to work with you. It is their right to have their voices heard and it is our responsibility to listen and address those concerns. Our focus remains on science, facts and what the majority of our residents have asked for. I truly look forward to having a conversation with you all, so we can mend some fences; all the while delivering a state of the art system for generations to come.

Beaver Mines Distribution and Collection System:

The drawings and the tender package by our Consultant will be ready by the middle of March 2021 with the hopes to start construction this spring for all aspects of the project, with completion expected in early 2022, once we have approval from Alberta Environment.
Beaver Mines Liftstation, Forcemain, and Waste Water Treatment System:

The drawings and the tender package for the lift station, force main, and the Waste Water Treatment System by our Consultants will be completed by the middle of March 2021 with the hopes to start construction commencing in spring of 2021 with a proposed completion in 2022, once we have approval from Alberta Environment.
Beaver Mines residential hookups:
-
The MD is planning to tender the work in early spring to connect all interested residents to the system to help reduce costs and facilitate coordination. The MD will soon contact all landowners to provide more information and get commitments for connection to get the most accurate pricing.
Residents will be responsible for paying for that portion between the main lines and/into their homes. There will be more discussion with our residents and updates on this soon.

Environmental Protection and Enhancement Act (EPEA)

On February 3, 2021, a letter was sent to AEP regarding the public engagement process to date, including the statement of concerns to support the request for adequate dialogue by AEP. The MD is requesting that the Director consider the responses provided to AEP on November 18, 2020, and are to the Director’s satisfaction from a technical perspective by Tuesday, February 9, 2021. Following up with AEP, they have requested more additional information where the MD has provided this to them. Should the responses be considered satisfactory, the MD hopes that a Draft Approval by the Director is issued to proceed with the approval process.
Week ending November 5, 2020 - no further update on the water/wastewater project, still awaiting AEP approval
November 3, 2020, Bylaw 1320-20 public hearing is scheduled for November 24, 2020. Please note it is in reference to the entire “Cowley - Castle Water Line”, wastewater services that already exist, and garbage collection in the collection areas throughout the MD. This bylaw is not specific to Beaver Mines. It is our Utility bylaw for the entire MD.
Due to covid restrictions, we are limiting the attendance within the MD chambers by reservation only, but will also be holding the meeting virtually. BM residents will be involved more than most going forward as we walk through hookups, street/traffic disruptions, and everything else. These items are NOT a part of the utility bylaw.
There is no need, at this time, to flood this event with a large group from any one area. Your participation is always welcome, but we want to ensure that everyone is aware this bylaw is for everyone and all utility services, not just BM Water and wastewater.

Castle Area Regional Water Supply Project Update (as of August 7, 2020):

Contract 1 – Pipeline:

The contractor has received utility locates around Beaver Mines. Due to delays in utility locates, the contractor has commenced other work within the project and will return to the Beaver Mines loop at a later date.

Installation of a total of 18,425 m out of the total 25,400 of water pipe completed;

The Castle Area Regional Water Supply is projected to be under budget with a proposed completion date at the end of November 2020.
Contract 2 – Mechanical:

Final commissioning for the booster stations will occur during August.
Beaver Mines Distribution and Collection System:

Drawings will be finalized over the next couple of months with an anticipated tender in November 2020.

In accordance with the Environmental Protection and Enhancement Act, the Municipal District of Pincher Creek No. 9 has applied to Alberta Environment and Parks for an approval to construct and operate the Beaver Mines Wastewater treatment plant. The wastewater treatment process includes one completely mixed aerated cell, two partially mixed aerated cells, one polishing cell, and Banner At-Grade system. The treated effluent will be disposed of to the Banner At-Grade system located at SE 16-006-02-W5M.
A directly affected person may provide input into certain regulatory decisions, as allowed by the Environmental Protection and Enhancement Act (section 73). Specifically, any person who is directly affected by this application may submit a written statement of concern within 30 days of the date of this notice to:

- state the distance between the land owned or used by the filer and the site in the application

Jeffrey Wu (AEP, Regional Approvals Engineer) issues a Draft Approval after 30 days

Banner and the MD review the Draft Approval with identification of any changes. If there are no changes, the MD provides acceptance signoff.

Statements of Concern are received from the 30 day Public Notice

AEP reviews the SOC to determine validity and requirements for response i.e. directly affected individuals, technical, potential environmental impact, nuisance, political, personal preference, etc.

The SOCs which are considered not valid are directly responded to by AEP either stating that the individual is not directly affected, not warranted, or that their concern is not within their boundaries to provide a response.

The SOCs which are considered valid are either directly responded to by AEP under the basis that the application document has adequately addressed their concern, or request additional information from us to include in their response.

Once the response is issued to the SOC, the director can consider these sufficiently addressed or include Conditions within the approval document to accommodate the SOCs.

The timing impact of any statement of concern, “valid” or not, will incur timing adjustments to the project and move our tender date to later in the year. It could take as little as 30-45 days, however it ultimately depends on the content of the SOC received. However, we believe that if we can still tender by late November to January, we will be able to take advantage of the lower construction costs being observed and ensure a competitive bid process.

Construction is expected to take between three to four weeks (weather depending). As construction is within the utility right-of-way, no traffic shall be disrupted.

What can we say? In a word, Grateful.
This week it was confirmed by the Minister of Transportation, The Hon. Ric McIver, that the MD of Pincher Creek was successful in obtaining funding through the Alberta Municipal Water/Wastewater Partnership (AMWWP). Administration applied for this grant for the Beaver Mines Wastewater Treatment Upgrade to stimulate economic recovery, support job creation, and have the funding available to complete the project without a burden to ratepayers.
Our Municipality will be receiving a grant of 75% the estimated eligible project costs, up to $4,561,730 for this project under AMWWP.
Alberta Transportation is pleased to be able to provide this funding. They recognize that supporting water and wastewater infrastructure is critical to the quality of life, economic growth, and resiliency of Alberta's communities.
Council acknowledges that without community support, and numerous letters to our Provincial colleagues for funding, this project wouldn't be proceeding as it is today. We look forward to seeing this $13M project move forward. As there are many components to the delivery of water and waste water services to this area, it is our plan for it to be fully completed and operational by Dec. 31, 2021. This is our target, but this will be influenced by approval wait times at many stages of the development which could push us into the 2022 calendar year for some components. Construction is slated to commence next month.
This is hardly a time of surplus in our Province, and for the Government to step up at this time and find creative ways to stimulate our economy and fund shovel-ready projects deserves to be recognized and applauded. We are truly appreciative of the Provincial and Federal support for this project.

The MD's contractors have begun clearing brush to allow for minor digging and geotechnical work to commence, locating the site for the Force Main and Lift Station required for the proposed Beaver Mines Water and Waste Water Systems being installed in 2020/2021.

The Municipal District of Pincher Creek No. 9 is pleased to announce that it will be proceeding with one of the land locations submitted under the Expression of Interest process for land acquisition. The site is located at SE 16-6-2-W5M, just northwest of the Hamlet and the 507 / 774 interchange.
This site is believed to provide a suitable location for the proposed wastewater treatment system to best meet the needs of the community. Site inspections and geotechnical evaluation will commence immediately to confirm the technical capacity and design requirements of the site.
Development Permit process has begun between the MD and the Project Managers and public involvement with this process will be advertised accordingly.
Once site suitability and development permits have been secured, the next step will be Environmental Approval with the Province.

Land Acquisition by the MD of Pincher Creek No. 9, near the Hamlet of Beaver Mines, for the purpose of constructing a waste water system. Current design, as was presented at Coalfields School on September 14, 2019, is for a 15-acre parcel to supply the hamlet with a waste water solution so that potable water may be delivered to the hamlet in 2020/21.

Beaver Mines Water and Waste Water Update
Hi Everyone,
Please note our land negotiations have had a significant setback. To this end, we will be advertising for interested landowners next week to continue this process. The MD is committed to finding a local solution to supplying water and a wastewater system for the Hamlet. We know this is disappointing for all involved, but we also trust there may be other viable options within the community and we truly hope to hear from those residents so we can move this project forward. Our engineers and land agents are ready to go as soon as the next site is selected. We will be limiting the window for interested parties to come forward to two weeks due to the timelines of our grant applications. We ask for your continued patience and cooperation and we hope to update you all again soon.

MPE received comments from MD on preliminary set of drawings last week. A revised set of drawings will be provided to the MD next week along with a set of specifications for review. Project to be finalized in November. Tentative tender date in January.
MPE has reached out to discuss timing of the project with Alberta Environment.

Based on site inspections by MPE Engineering on September 11, 2019, DMT Mechanical achieved total completion by September 13, 2019. A site inspection will be held on September 25, 2019 to confirm with the MD of Pincher Creek. A reminder that grass seeding and any further settlement over the winter will be considered warranty items for the contractor to address in the spring.

LW Dennis has completed approx. I 0,200 meters of pipeline installation.
o Adverse ground conditions have continued to slow progress and a revised substantial completion date will be issued for the contract. The date will be discussed and agreed to by all parties prior to issuing. A revised contract date will need to be coordinated with the estimated completion date of the Beaver Mines W and WW system. No requests for additional funding will be allowed by contractor or consultant.
