  1. Print the documents off the Alberta Purchasing Connection (APC) Website at: http://www.purchasingconnection.ca/.
Quotes or Quote Amendments received via Facsimile transmission will not be accepted. Potential Work includes, but is not limited to the following:
  • Supply of Designation 4 Class 25 Crushed Gravel
The Quote submissions must be accompanied by a Quote Security Bond (Bid Bond) in the amount of $20,000.00. In lieu of the Bond, a Certified Cheque or an Unconditional, Irrevocable, and Self Renewing Letter of Credit in the above required amount, and from a Schedule 1 Chartered Bank, or Province of Alberta Treasury Branch, submitted with their Quote, will be accepted.
 
All Contractors chosen by the MD of Pincher Creek to enter into a gravel supply contract will also be required to supply a Performance Bond in the amount of $50,000.00.

 This Performance Bond shall be maintained in force for the duration of the Contract and shall     be in a form approved by the Owner, from a recognized surety company.
 
In lieu of a Performance Bond, the MD will accept an unconditional, irrevocable and self-renewing letter of credit in the above required amount from a Schedule 1 Chartered Bank or Province of Alberta Treasury Branch, and such letter of credit will remain in force for the duration of the Contract.
 
Receipt of a Quote and evaluation by the Owner of a quote submission does not imply that a contract will be entered into with any or all Contractors that submit a quote. The Owner reserves the right to waive informalities, reject any or all Quotes, or to accept the Quote or Quotes deemed most advantageous to the interests of the Owner.
 
Please note that various supply quantities and locations of gravel crush and stockpile are required throughout the MD. Each submission will be evaluated on the basis of a combination of location, price, quality and quantity to achieve the best overall value to the County. To this end, each pay item and each quantity sub-item within the pay items shall be considered as "PROVISIONAL", and the MD reserves the right to award or not award individual sub-items as separate contracts to different contractors, utilizing any or all individual Quote pay sub-items at the MD’s unfettered discretion, and reserves the right to negotiate with one or more of the Proponents without having to negotiate the same or similar terms with any or all other Proponents.
 
The lowest Quote or any other quote will not necessarily be accepted. the MD may consider any other factor besides price and capability to perform the work that it deems in its sole discretion to be relevant to its decision including but not limited to the following: Notwithstanding any other provision, by submitting a Quote, each Proponent agrees that any claim that the Proponent may have against the MD and the MD’s affiliates (and their employees, agents, consultants and elected officials) for damages, losses, or expenses or for any other legal relief, arising, directly or indirectly, under or in relation to this Request for Quotes process (whether in contract, tort, or other legal theory) is limited to an amount equal to the Proponent’s actual and reasonable costs in preparing its Proposal to a maximum of $2,500.00 (two thousand five hundred dollars). For clarity, each Proponent specifically waives, as against the parties, any claim for loss of profit or anticipated profit, loss of opportunity, loss of reputation, consequential or indirect losses, or for judicial review or injunctive relief.
 
Quote submissions will only be accepted from Proponents who have acquired a copy of the Original RFQ Quote Document; available as noted previously.
 
Quotes will not be opened publicly.
